Terms of Service
1. Purpose
These terms set out the conditions for using the JONIVIEW app, the website joniview.com and related services (the “Service”) provided by LivingHits (“we”, “us”), and the rights, duties and responsibilities of you and us.
2. Definitions
- “App” means the JONIVIEW Android app we distribute through Google Play and similar stores.
- “Car screen” means the web browser screen of a car or device connected to your phone’s hotspot (Wi-Fi).
- “Lifetime license” means the right, after a one-time payment, to use the App’s paid features without further charges for as long as we offer the Service (section 7).
- “Account” means the Google account or similar sign-in you use to verify your license and register devices.
3. Posting and changes
- We post these terms on the website and in the App.
- We may change these terms within the limits of the law. We will announce changes, with the effective date and reason, on the website and in the App at least 7 days in advance, and at least 30 days in advance with a separate notice (for example by email or in-app notification) for changes that are unfavourable to you or significant.
- If our notice clearly and separately tells you that you will be treated as accepting the change unless you object before the effective date, and you do not object, you will be treated as having accepted the change. However, a change that materially disadvantages a license you have already bought, such as a lower device limit or a shorter period of use, is not treated as accepted in this way; if you do not agree, we will keep your previous conditions or, where that is not practicable, refund you as required by law.
- If you do not agree to a change, you may stop using the Service and delete your account.
4. The Service and what you need
- The Service shows your Android phone’s screen on the car screen and lets you control the phone from the car screen. The picture and your touches travel only between your phone and your car within the same hotspot; they do not pass through our servers.
- You need an Android phone with a hotspot and a car (or device) with a web browser. Depending on the make, model and software version of the car and phone, or your carrier’s settings, some features may not work and picture quality or responsiveness may vary.
- Controlling the phone from the car screen uses Android’s Wireless debugging (a developer option). The App turns this on only with your consent, and you can turn it off at any time in your phone’s settings (touch control may then stop working). While it is on, avoid connecting to Wi-Fi networks or devices you do not trust.
- Apps and videos protected by copy protection (DRM) may not appear on the car screen (for example, they may appear black).
- Before you pay, you can install the App for free to check that it connects with your car and phone, and the App offers a way to try the paid features.
5. Accounts
- You may sign in with a Google account or similar to buy and verify a lifetime license and register devices.
- You are responsible for your account and registered devices and must not let others use them.
- You must be at least 14 years old (or the minimum age required in your country, if higher) to create an account.
6. Purchases by minors
A minor needs the consent of a parent or legal guardian to make a paid purchase. Where a minor pays without that consent, the minor or the guardian may cancel the contract as allowed by applicable law.
7. Lifetime license
- The App is free to install. Full features require a paid lifetime license. The price is shown on the payment screen.
- “Lifetime” means for as long as we offer the Service, not for your lifetime. During that period you can use it without further payment.
- A license belongs to the account that bought it and cannot be transferred, sold or lent to another account.
- The number of devices you can register per license and the conditions for changing devices are shown in the App before you pay.
- Payment is processed through Google Play, and Google Play’s terms and policies also apply to payment methods, receipts and cancellations.
- A license is a right to use the Service under these terms; it does not transfer ownership of the App or its software.
8. Withdrawal and refunds
- A lifetime license is digital content that starts to be supplied as soon as you pay. Before you pay, we show on the payment screen that the right of withdrawal is limited once supply starts and ask you to confirm and agree, and we offer the trial described in section 4(5). In that case, under Korean law, you cannot withdraw simply because you changed your mind once supply has started.
- Even so:
- within 48 hours of purchase you can request a refund directly from Google Play under Google Play’s refund policy;
- if the license does not match its description, advertising or the contract, or is not supplied as agreed, you may withdraw within 3 months of receiving it and within 30 days of when you learned or could have learned of this; and
- we will refund or compensate you in other cases required by applicable law.
- Where Google is the seller of your purchase (for example in the European Economic Area and the United Kingdom), Google Play’s terms on cancellation and refunds apply, together with your statutory rights.
- Send withdrawal or refund requests to the contact below. Once confirmed, we refund through Google Play within the period required by law. When the refund reaches you depends on Google Play and your payment method.
- A refunded license stops working.
9. Changes, interruptions and discontinuation
- We may change all or part of the Service for operational or technical reasons. We will announce significant changes that are unfavourable to you in advance as described in section 3(2).
- We may interrupt the Service temporarily for maintenance, equipment failure, network outages, power cuts, natural disasters, outages of outside services such as Google Play, or other events beyond our control. We will tell you in advance where possible, or otherwise without delay afterwards.
- Policy or software changes by car, phone or operating-system makers or other app developers (for example restrictions in a car’s browser or changes to Android) may stop parts of the Service from working. We will make reasonable efforts to fix this but cannot guarantee a fix.
- We may discontinue the Service for business reasons. We will announce this in the App and on the website at least 30 days before the end date and notify users whose contact details we have, for example by email.
- If we discontinue the Service, refunds or compensation for lifetime-license holders will follow applicable law.
10. Use while driving and safety
- Drivers must not watch video on the car screen or operate the car screen or phone while driving. In Korea, article 49 of the Road Traffic Act prohibits displaying video where the driver can see it while driving (navigation and traffic information excepted) and operating a video display while driving (except when stopped, among other exceptions). Elsewhere, follow the laws of the place where you drive.
- Watch video only while parked, stopped or charging. While driving, use the Service only for things that do not distract you, such as navigation or music, set up before you set off.
- The driver decides whether and how to use the Service in light of the road conditions. The driver who uses the Service while driving is responsible for any resulting accidents, traffic violations and fines.
- Navigation directions and other information shown on the car screen come from the apps that provide them; we do not guarantee their accuracy. Always follow actual road conditions and traffic rules first.
- The Service does not replace the car’s driving or safety functions, such as the instrument cluster, rear-view camera or warnings. Do not use the Service in a way that covers or interferes with them.
11. Prohibited conduct
You must not:
- circumvent copy protection (DRM) or other technical protection measures, or copy, distribute or publicly show content you have no rights to;
- reverse-engineer or modify the App, or bypass license checks or device limits, except as permitted by law;
- sell or lend a license or account;
- access other people’s accounts, devices or cars without permission; or
- interfere with the operation of the Service or break the law.
12. Content and intellectual property
- The Service is a tool that moves your phone’s screen to the car screen; we do not provide, store or transmit content. The terms of each app provider and rights holder govern the apps, videos, music and other content you open on your phone, and you are responsible for complying with them.
- We or the rightful owners hold the intellectual property rights in the App, the website and the JONIVIEW name, logo and character. We grant you only a personal, non-transferable, non-exclusive right to use the Service under these terms.
13. Suspension and termination
- You may end your contract at any time by deleting your account. Deleting your account also removes the lifetime license on that account, and it cannot be restored. Refunds follow section 8. Uninstalling the App alone does not delete your account.
- If you engage in conduct prohibited by section 11, we may restrict your use or terminate the contract after notifying you and giving you a chance to fix it. Where there is an urgent risk of illegality or to the security of the Service, we may restrict use first and notify you without delay.
- You may object to a restriction by contacting us, and we will review it and tell you the outcome. If we restricted your use by mistake, we will lift the restriction immediately.
- If the contract is terminated because you breached these terms, whether and how much we refund follows applicable law.
14. Limitation of liability
- If we cause you loss intentionally or negligently, we will compensate you as required by applicable law.
- Unless we acted intentionally or with gross negligence, we are not liable for loss caused by:
- events beyond our control, such as natural disasters, war, power cuts or network outages;
- the specifications, settings, updates or faults of your car, phone, mobile plan, hotspot, car browser or operating system;
- outages or policy changes of third-party services we do not control, such as Google Play, Google accounts or carriers;
- policy or software changes by makers or developers described in section 9(3);
- the content or accuracy of other apps or content you show through the Service; or
- your own intentional or negligent acts, including use while driving, breaches of these terms or the law, or failure to look after your account.
- For loss caused by our slight negligence, we compensate only ordinary loss (not special loss), up to the amount you actually paid for the license concerned.
- For features and trials provided free of charge, we are not liable unless we acted intentionally or with gross negligence.
- We do not warrant that the Service will work without interruption or error on every car and phone. We remain responsible for what we state in the App’s description and our advertising.
- Sections 14(2) to 14(5) do not apply to death or personal injury, to liability under data-protection law, or to any other liability that cannot be excluded or limited by law.
15. Privacy
We handle your personal information in accordance with applicable law and our Privacy Policy.
16. Notices
- We send individual notices to your account email or by in-app notification.
- Notices to all users may be given by posting on the website and in the App for at least 7 days, except that matters with a significant effect on you will be notified individually.
17. Resolving disputes
We handle your feedback and complaints promptly, and if we cannot resolve something right away we will tell you why and when we expect to. Users in Korea may also apply for mediation to the Korea Consumer Agency (1372) or the Content Dispute Resolution Committee (www.kcdrc.kr).
18. Governing law and courts
- These terms and your use of the Service are governed by the laws of the Republic of Korea. If you are a consumer living outside Korea, you keep the protection given to consumers by the mandatory laws of your country of residence.
- Lawsuits between you and us fall under the exclusive jurisdiction of the district court for your address (or residence) at the time the suit is filed, as provided by Korean law; if neither is clear, the court determined under the Korean Civil Procedure Act has jurisdiction. If you are a consumer living outside Korea, you may also bring proceedings in the courts that the law of your country of residence allows.
19. General
- If any provision of these terms is held invalid, the rest remain in effect.
- Our not exercising a right under these terms is not a waiver of that right.
- Matters not covered by these terms are governed by applicable law and general commercial practice.
- Nothing in these terms limits any rights you have under mandatory consumer law that cannot be excluded by agreement.
